Complaints procedure

Marxman Advocaten attaches great importance to the satisfaction of its clients. Our firm will therefore do everything in its power to provide you with the best possible service. However, you may still be dissatisfied with a certain aspect of our services, such as the quality of our services or an invoice.

If this is the case, we ask you to first submit your objections to your own lawyer. However, you can also contact the complaints officer of Marxman Advocaten, Sebastiaan Palm. The complaints officer will handle your complaint according to a procedure described in our complaints procedure.

We will try to find a solution to the problem in consultation with you as quickly as possible. We will always confirm this solution to you in writing. In principle, you can expect our written response to your complaint within four weeks. If we need more time, we will let you know in advance, stating the reasons.

Disputes Committee for the Legal Profession

Marxman Advocaten is a member of the Disputes Committee for the Legal Profession. In the unlikely event that we are unable to resolve a dispute by mutual agreement, you may submit your complaint to the Disputes Committee for the Legal Profession no later than 12 months after the date of our written response.

Are you a private client? The Legal Profession Disputes Committee Rules will provide for binding advice, unless you apply to the ordinary courts within one month after the handling of the complaint.

The Disputes Committee for the Legal Profession is competent to adjudicate on complaints about the quality of the services rendered by the lawyer and the amount of the invoice. It is also possible that you feel that you are entitled to compensation. The Disputes Committee for the Legal Profession is competent to adjudicate on damage claims up to a maximum of €10,000. You may only submit higher claims to the Disputes Committee for the Legal Profession if you limit the claim to €10,000 and relinquish the remainder in writing.

Marxman may submit unpaid invoices for collection to the Disputes Committee for the Legal Profession. In this case, the advice is only considered binding if you deposit the outstanding amount to the Disputes Committee. If you fail to do so, arbitration will be applicable to the debt collection. The Disputes Committee will handle the case in accordance with the Disputes Committee for the Legal Profession Rules applicable at the time the complaint was submitted to the Disputes Committee.

The judgement delivered by the Disputes Committee cannot be appealed.
